AFTER MORE THAN 18 YEARS OF LEGAL BATTLES, LIVINGSTON COUNTY CONCLUDES SAGA OF JEROME KOWALS

HOWELL, Mich. — Following more than eighteen years of trials, appeals, vacated verdicts, and state judicial scandal, the protracted legal battle surrounding 80-year-old Jerome “Jerry” Kowalski has reached its final disposition in Livingston County Circuit Court.

​Presiding Shiawassee County Circuit Court Judge Matthew Stewart sentenced Kowalski to time served, concluding one of Michigan’s most scrutinized and convoluted murder cases dating back to May 2008.

​Case Background and the Decades-Long Timeline

  • ​The 2008 Incident: Jerome Kowalski was charged in connection with the fatal shootings of his brother, Richard Kowalski, and sister-in-law, Brenda Kowalski, at their home in Livingston County’s Oceola Township.
  • ​2013 Conviction & Judicial Scandal: Kowalski was convicted of first-degree murder in 2013 and sentenced to life imprisonment. However, the conviction was vacated in 2019 after revelations emerged regarding a hidden affair between presiding 53rd District Court Judge Theresa Brennan and lead investigator Detective Sgt. Sean Furlong of the Michigan State Police. The misconduct resulted in Brennan’s removal from the bench by the Michigan Supreme Court.
  • ​Pre-Trial Release & Cobbs Agreement: After spending 13 years and eight months behind bars, Kowalski was released on bond in 2023. Facing a protracted retrial, Kowalski entered a no-contest plea under a judicial Cobbs agreement.
  • ​The Final Resolution: Following a degree hearing where the court evaluated the remaining evidence, Judge Stewart determined there was insufficient evidence to justify first-degree murder charges and reduced the counts to second-degree murder, formally sentencing Kowalski to the nearly 14 years he had already served.

​Significance for Michigan Jurisprudence

​The conclusion of the Kowalski case marks the end of an 18-year chapter that fundamentally altered judicial oversight, prosecutorial ethics, and appellate review in Michigan courts. While state prosecutors consistently maintained objections to the Cobbs plea arrangement, the final ruling permanently closes the docket on a case defined by prosecutorial conflicts, extensive retrial delays, and systemic scrutiny.
